Questioner: Opposing the opinion of the Jumhur (the majority of scholars)? Sheikh: Opposing the opinion of the Jumhur for the dalil (textual evidence i.e., Quran and Sunnah) is obligatory. As for without a dalil, then there is no doubt that the soul feels more reassured with (following) the majority than the minority. If there is a dalil, then it is obligatory to follow it, whether it is in accordance with the opinion of the jumhur or majority, or in opposition (to it). However, if there isn't a dalil, then a person, like how each of us feels, is more reassured with the opinion of the majority than the minority. So, the fundamental principle is to follow the dalil from the Kitab and Sunnah. Ao, if there is no dalil with the student of knowledge, then the soul is reassured by following the opinion of the Jumhur. However, if we oppose the opinion of the Jumhur for the opinion of the minority because the soul is reassured by the opinion of the minority, then there is no problem with that because of his saying (the Prophet’s ﷺ ) "Consult your heart, even if the muftis issue you fatawa."
